Tangled Ventures ("our", "us", "we", "Tangled Ventures") owns, operates, and maintains www.ibcgame.com.au and all of the various pages contained therein, including subdomains (the "Website"), and the related products and services provided through the Website are subject to the following terms and conditions. Tangled Ventures also owns the all relevant commercial rights to the strategic card game known as Interplanetary Battle Cards (“IBC Game”).

Tangled Ventures includes its directors, officers, shareholders, members, employees, contractors, advisors, representatives, subcontractors, consultants, legal advisers, agents, suppliers, distributors, licensees and licensors (current and past) and any affiliates, individually and collectively, and any related individuals or entities.

1. Acceptance of Terms

1.1. Your access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms and conditions (the "Terms of Service").

1.2. By using the Services, you are agreeing to all of the below Terms of Services, which may be updated by us from time to time without notice. You should check this page regularly to take notice of any change we may have made. 

1.3. These Terms of Service incorporate our Privacy Policy, which sets out how we will use your information. By using the Services, you consent to the processing of information as described therein and certify that all data provided by you is accurate. 
 

2. Eligibility

2.1. Users must comply with any eligibility criteria specified on the Website for specific games or features.

3. Registration
3.1. You may be required to register an account, including third-party merchants, to access certain features of the Website. You are responsible for providing accurate and up-to-date information during the registration process.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5.1. All right, title and interest in and to the Website and our products and services are and shall remain the exclusive property of Tangled Ventures. The Website and our products and services are protected by copyright and other laws. Nothing in these Terms of Service gives you the right to use or reproduce any of our logos, domain names and other distinctive brand features. 

5.2. On the condition of your acceptance of these Terms of Service, we grant you a non-exclusive, limited, non-transferrable, freely revocable license to use the Website and its contents for your personal, non-commercial use. We reserve all rights not expressly granted. 

5.3. The products sold by us to you (via the Website or in-person) is for personal use only.

5.3. Tangled Ventures utilises commercially licensed AI-generated artwork in its products and services. 

6. Purchases, Payments and Prices

6.1. Tangled Ventures may sell IBC Game related products on this Website, and offer game related purchases or premium features. 

6.2. By placing an order, you acknowledge you are entering into a contract of sale with Tangled Ventures. In order to contract with us, you must be at least the age of majority in your state or province of residence, or the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Website. You must possess a valid credit or debit card issued by a bank acceptable to us. We retain the right to refuse any request made by you. Our contract will form once your payment has been approved, processed and received by Tangled Ventures. 

6.3. All prices are in Australian dollars (AU$) and are exclusive of GST (at this time). Our Website accepts payments using Paypal and Stripe. 

6.4. Tangled Ventures takes all steps to ensure that prices are correct at the time of publication, however, we reserve the right to alter prices should we inadvertently public publish incorrect prices. If this should happen after you have ordered a product on the site and have passed through the checkout, we will contact you prior to sending your order and notify you of the correct price. You will then have the choice to either proceed with your order or cancel the same.

6.6. We will also endeavour to maintain the stability of our prices, but as a small business, we can only order inventory in small batches. Accordingly, if our supplier or postage prices increase materially, we may be required to adjust our prices accordingly.

7. Postage

7.1. We use Australia Post to service the shipping of orders within Australia, no international orders are accepted at this time.

7.2. Orders within Australia are usually dispatched within 1-3 business days after payment.

7.3. For orders under $100, we charge a flat rate of $10.00 for standard shipping (with tracking number).

7.4. For orders over $100, standard shipping (with tracking number) is included free of charge.

7.5. Express postage is available at additional charge.

7.6. In addition to the above, further terms and conditions may apply at checkout.

8. Exchanges, Returns and Refunds

 

Return for exchange (change of mind not accepted)

8.1. Please choose carefully, as we normally do not accept change of mind, or where you make a wrong decision refund, given the collectable nature of IBC Game as a trading card game. You can choose between a refund, exchange or credit where goods are faulty, have been wrongly described, are different to the product purchased on the Website or don’t perform as advertised.    

8.2. Otherwise, we will exchange products within 14 days of purchase as long as the product is in its original packaging, in original condition and has not been opened. 

8.3. Except where goods are faulty, for Refunds and Exchanges, freight costs, to return the product to us by Courier and/or to resent the new item back to the customer are to be covered by you (as the customer). 

8.4. Tangled Ventures is not responsible for any lost or damaged returned parcels and so we recommend the product be sent back via an insured and traceable method such as registered post or traceable courier. 

8.5. Except where goods are faulty, for refunds and exchanges, freight costs, to return the product to us by post or courier and/or to resent the new item back to the customer are to be covered by you (as the customer). 

8.6. Sale or discounted items can only be returned for store credit or exchange and not for refund.

Where a product is faulty 

8.7. All exchanges and returns must be returned to us within 14 days of you (the customer) receiving the product. Please contact tangled.ventures@gmail.com to arrange a return for the product. Once we receive the faulty item we will assess and, upon confirmation of the fault or defect, arrange an exchange or full refund. 

9. Disclaimers, Limitation of Liability and Indemnity 

9.1. The Website is provided “as is" without warranties or guarantees of any kind, either express or implied. We reserve the right to change, delete or move any of the material on the Website at any time without notice. 

9.2. To the greatest extent permitted by law, Tangled Ventures and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the Website and the Services. This includes but is not limited to viruses alleged to have been obtained from using the Website, your use or reliance on the Website or any information or materials available on the Website, accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose,  regardless of the type of claim or nature of the cause of action.

9.3. You agree to indemnify and hold harmless Tangled Ventures, its directors, employees, contractors, agents and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website, the Services or your breach of these Terms of Service.

10.1. If we link to other third-party websites, we take no responsibility for the content of, and make no representation as to the accuracy of these websites.  

11. Governing Law

11.1. These Terms of Service are governed by and construed in accordance with the laws of the Northern Territory of Australia. You agree to submit to the exclusive jurisdiction of the courts located in the Northern Territory of Australia for the resolution of any disputes.

12. Severability 

12.1. Any provision in these Terms of Service wihch is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforcable, and otherwise must be servered to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms of Service or affecting the validity of enforceability of that provision in any other jurisdiction.
